What information do we collect?

Personal information you disclose to us

In short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide when you express an interest in obtaining information about us or our products and Services, participate in activities on the Services, or otherwise contact us.

Sensitive information. We do not process sensitive information.

Application data. If you use our applications, we may collect the following information if you choose to provide access or permission:

• Geolocation information. We may request access or permission to track location-based information from your mobile device, either continuously or while you use our applications, to provide location-based services. You may change these permissions in your device settings.
• Mobile device access. We may request access or permission to certain features from your mobile device. You may change these permissions in your device settings.

This information is primarily needed to maintain the security and operation of our applications, for troubleshooting, and for internal analytics and reporting.

All personal information you provide must be true, complete, and accurate, and you must notify us of changes to that information.

How do we process your information?

In short: We process your information to provide, improve, and administer our Services, communicate with you, prevent fraud, maintain security, and comply with law. We may also process your information for other purposes with your consent.

What legal bases do we rely on?

In short: We only process personal information when we believe it is necessary and have a valid legal reason under applicable law, such as your consent, compliance with laws, fulfilling contractual obligations, protecting your rights, or pursuing legitimate business interests.

We may process information if you have given us specific permission (express consent) for a specific purpose, or where permission can be inferred (implied consent). You can withdraw consent at any time.

In exceptional cases, applicable law may permit us to process information without consent, including:

• When collection is clearly in an individual’s interests and consent cannot be obtained in time.
• For investigations, fraud detection, and fraud prevention.
• For business transactions when legal conditions are met.
• When contained in a witness statement and needed to assess, process, or settle an insurance claim.
• To identify injured, ill, or deceased persons and communicate with next of kin.
• When we reasonably believe an individual has been, is, or may be a victim of financial abuse.
• When collection with consent would compromise information needed to investigate an agreement or Canadian law.
• When disclosure is required by subpoena, warrant, court order, or court rules.
• When produced during employment, business, or professional activity and collection matches its purpose.

When and with whom do we share information?

In short: We may share information in specific situations described below.

Business transfers. We may share or transfer information in connection with, or during negotiations of, a merger, sale of company assets, financing, or acquisition of all or part of our business.

How long do we keep your information?

In short: We keep information for as long as necessary to fulfill the purposes outlined in this notice unless otherwise required by law.

We retain personal information only as long as needed for the purposes set out in this notice, unless a longer period is required or permitted by law, such as for tax, accounting, or other legal requirements.

When we have no ongoing legitimate business need to process information, we will delete or anonymize it. If that is not possible, such as in backup archives, we will securely store and isolate it until deletion is possible.

Do we collect information from minors?

In short: We do not knowingly collect data from or market to children under 18.

We do not knowingly collect or solicit data from, market to, or sell personal information about children under 18. By using the Services, you represent that you are at least 18, or are the parent or guardian of a minor and consent to that dependent’s use of the Services. If we learn that information from a user under 18 has been collected, we will take reasonable measures to deactivate the account and promptly delete the data. What are your privacy rights?

In short: In some regions, including Canada, you have rights that allow greater access to and control over your personal information.

Depending on applicable law, these rights may include requesting access to and a copy of your information, rectification or erasure, restriction of processing, data portability, and the right not to be subject to automated decision-making. In certain circumstances, you may also object to processing.

We will consider and act upon requests in accordance with applicable data protection laws.

Withdrawing your consent. When we rely on express or implied consent, you may withdraw it at any time by contacting us. This will not affect the lawfulness of processing before withdrawal or processing based on other lawful grounds.

Controls for Do-Not-Track features

Most web browsers and some mobile operating systems and applications include a Do-Not-Track (“DNT”) setting. No uniform technology standard for recognizing and implementing DNT signals has been finalized, so we do not currently respond to DNT browser signals or other automatic tracking preferences. If a standard we must follow is adopted, we will describe that practice in a revised notice.

Trade knowledge

The Sparky Software is not liable for information leading to property damage, injury, or loss of life. These tools are intended for licensed electricians in Canada and are based on the 2021 Canadian Electrical Code. Apply all information with trade knowledge and common sense. Variables such as temperature may change pipe-fill results.

Do we make updates to this notice?

In short: Yes. We update this notice as necessary to stay compliant with relevant laws.

The updated version will be identified by the revised date at the top of this page. If we make material changes, we may notify you by prominently posting a notice or sending a direct notification. We encourage you to review this notice regularly.
